Steel Forge Tools is a product and service brand operated by Phoenix Rail & Iron LLC.
All software, downloads, support, billing, customer service, and business operations related to Steel Forge Tools are managed exclusively through Phoenix Rail & Iron LLC.

Intended Use
Permitted Use
The Service is intended to assist fabricators, welders, machinists, hobbyists, contractors, and related trades by providing digital fabrication tools, printable templates, calculators, downloadable software, and related fabrication resources.
You may use generated outputs for personal use, shop use, or commercial fabrication work.
Prohibited Use
You agree not to:

Use the Service for unlawful purposes

Attempt to gain unauthorized access to our systems, servers, or accounts

Interfere with the operation or security of the Service

Use bots, scraping tools, or automated systems to copy or harvest data from the Service

Misrepresent our tools or outputs as your own software or service
Accuracy, Verification, and Fabrication Responsibility
IMPORTANT: All generated templates, dimensions, calculations, STL files, DXF files, PDFs, and other outputs must be independently verified by the user before fabrication, cutting, welding, machining, installation, or production use.
While we make reasonable efforts to provide accurate tools and calculations, the Service is provided “as is” and “as available” without warranties of any kind.
You are solely responsible for:

Verifying all dimensions and fitment

Confirming material suitability

Performing test fits and validation

Following applicable laws, codes, standards, and engineering requirements

Safe operation of fabrication equipment and machinery

Inspecting and validating all generated outputs prior to use

No Engineering or Professional Advice
The Service is provided for informational and fabrication assistance purposes only and does not constitute engineering, architectural, structural, code compliance, manufacturing, or professional advice.
Use of the Service does not create any professional, engineering, consulting, or advisory relationship between you and Phoenix Rail & Iron LLC.
Users are solely responsible for determining whether generated outputs are appropriate for their intended application.
Safety Notice
Metal fabrication, welding, plasma cutting, machining, grinding, and related activities involve inherent risks that can result in serious injury, death, fire, or property damage.
Users are solely responsible for:

Our software and templates are not a substitute for professional training, engineering review, safe operating procedures, or common sense.
Limitation of Liability
USE OF THE SERVICE IS AT YOUR OWN RISK.
To the fullest extent permitted by applicable law, Phoenix Rail & Iron LLC, Steel Forge Tools, and their owners, employees, affiliates, contractors, licensors, suppliers, and representatives shall not be liable for any claims, damages, losses, liabilities, costs, or expenses of any kind arising from or related to use of the Service or reliance on any generated outputs.
This limitation applies to all damages of every kind, including but not limited to:

Material waste or scrap

Incorrect templates, dimensions, calculations, or layouts

Improper fitment or fabrication errors

Machine crashes or CNC/controller failures

Damage to tools, machinery, equipment, or workpieces

Welding defects or structural failures

Loss of production time

Downtime or business interruption

Loss of contracts, profits, revenue, or customers

Personal injury or death

Property damage

Third-party claims

Data loss or software incompatibility

Errors, bugs, omissions, or interruptions in the Service
The Service and all generated outputs are provided “AS IS” and “WITH ALL FAULTS,” without warranties of any kind, whether express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, accuracy, non-infringement, or suitability for fabrication, machining, welding, engineering, or structural applications.
Phoenix Rail & Iron LLC does not warrant that the Service will be error-free, uninterrupted, compatible with your equipment, or suitable for any specific use or project.
You acknowledge and agree that:

All generated outputs must be independently verified before use

You are solely responsible for all fabrication decisions and safety practices

You assume all risks associated with cutting, welding, machining, fabrication, installation, and use of produced parts

The Service is a drafting and fabrication aid only and not a substitute for engineering review, professional judgment, or physical verification
To the fullest extent permitted by law, the total cumulative liability of Phoenix Rail & Iron LLC arising from or related to the Service shall not exceed the amount paid by you, if any, for access to the Service during the twelve (12) months preceding the claim.
Some jurisdictions do not allow certain limitations of liability, so portions of this section may not apply to you.
Intellectual Property
All software, designs, graphics, branding, code, calculations, interfaces, documentation, and underlying tool logic remain the property of Phoenix Rail & Iron LLC unless otherwise stated.
Purchasing or using our products does not transfer ownership of the software itself.
Generated outputs such as PDFs, DXFs, STL files, templates, and printed layouts may be used in your own fabrication projects, including commercial work. However, you may not:

Repackage or resell the software itself

Clone or reproduce the Service as a competing product

Distribute modified versions of our software without permission
Digital Products and Downloads
Due to the nature of digital products, all sales are generally final unless otherwise required by law.
We reserve the right to update, modify, discontinue, replace, suspend, or remove digital products, downloads, calculators, software, or features at any time without notice.
Compatibility with specific machines, operating systems, slicers, printers, CNC controllers, fabrication equipment, or workflows is not guaranteed unless explicitly stated.
User Accounts
If you create an account, you are responsible for maintaining the confidentiality and security of your login credentials and for all activity occurring under your account.
We reserve the right to suspend or terminate accounts that violate these Terms or misuse the Service.
Service Availability
We do not guarantee uninterrupted, secure, or error-free operation of the Service.
Features, downloads, calculators, software tools, or entire sections of the Service may be modified, suspended, or discontinued at any time without prior notice.
Indemnification
You agree to defend, indemnify, and hold harmless Phoenix Rail & Iron LLC, Steel Forge Tools, and their owners, employees, affiliates, contractors, licensors, and representatives from and against any and all claims, demands, actions, damages, losses, liabilities, judgments, settlements, penalties, fines, costs, and expenses, including reasonable attorney’s fees, arising out of or related to:

Any fabrication, machining, welding, cutting, manufacturing, installation, or construction activity related to use of the Service

Violations of laws, codes, regulations, or industry standards

Any commercial or production losses

Your violation of these Terms
You acknowledge that all outputs generated by the Service must be independently verified prior to use and that Phoenix Rail & Iron LLC is not responsible for the accuracy, suitability, or fitness of generated outputs for any specific application.
Dispute Resolution, Arbitration, and Class Action Waiver
Any dispute, claim, or controversy arising out of or relating to the Service or these Terms shall first be attempted to be resolved through good-faith informal negotiations.
If a dispute cannot be resolved informally, the dispute shall be resolved exclusively through binding arbitration conducted in the State of Maine in accordance with the rules of the American Arbitration Association or a substantially similar arbitration body chosen by Phoenix Rail & Iron LLC.
You agree that:

Arbitration shall be conducted on an individual basis only

You waive any right to participate in a class action lawsuit or class arbitration

You waive any right to a jury trial

Any claim must be brought in your individual capacity and not as part of any collective or representative proceeding
Notwithstanding the foregoing, Phoenix Rail & Iron LLC may seek injunctive relief or pursue claims related to intellectual property, unauthorized access, misuse of software, or nonpayment in any court of competent jurisdiction.
Venue and Jurisdiction
To the extent any dispute is permitted to proceed in court rather than arbitration, you agree that such dispute shall be brought exclusively in the state or federal courts located in the State of Maine.
You consent to the exclusive jurisdiction and venue of such courts and waive any objection based on inconvenient forum or lack of personal jurisdiction.
Attorney’s Fees
In any action or proceeding arising out of or related to these Terms or the Service, the prevailing party shall be entitled to recover its reasonable attorney’s fees, costs, and expenses.
Changes to These Terms
We may update these Terms from time to time. Continued use of the Service after changes are posted constitutes acceptance of the revised Terms.
Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of Maine, without regard to conflict of law principles.
